A Word From Your President


Dear Members:


 One of my biggest concerns for this entire year is choosing the entertainment for the support staff luncheon.
 
We have certainly had some interesting presentations over the last decade. That said, I would ask that you pass this letter on to your staff and seek their input on interesting and appropriate presentations. 


I believe that even if I do not get a great suggestion, I will at least have a bit of a defense when people are rolling their eyes and muttering.

WCBA Board Minutes -  Thursday, September 18, 2008, 12:00 p.m.

Attendance:    Dan Habeck, President; Doug Swanson, President-Elect; Christy D'Angelo, Secretary/Treasurer; Marjorie Wendt; Jeff Zirgibel; Michelle Martin; Danni Caldwell; Linda Van De Water & Sharron Stolpa.

Minutes:  The minutes of the August 21, 2008, meeting were approved.

Treasurer and Membership Report:   402 membership applications had been received for the 2008-2009 membership year.
18 Month CD: $13,999.26

Old Business and Committee Reports

State Board of Governors: The Board of Governors acted on 10 petitions at its September 12-13, 2008, meeting. These included petitions on electronic filing, use of unpublished opinions, and changes to the Board of Bar Examiners rules allowing conditional admission to the Bar, among others. For further information on any of the petitions, you may contact our Board of Governors representatives: Attorney C. Michael Hausman, Attorney Jeffrey Zirgibel and Attorney Sam Benedict. 

Scriptus/Website:  The next issue of the Scriptus will be sent out next week, September 22, 2008.

September 24, CLE: 34 people have preregistered for the CLE provided by Wisconsin Lawyers Mutual Insurance Company to be held at the courthouse over the lunch hour.

Printer Purchase: Sharron Stolpa reported that she has purchased a printer for her use as the Administrative Assistant.

Juror Appreciation Month: September is Juror Appreciation Month. The Waukesha County Bar Association donated a framed photograph of the first Wisconsin jury to include female jurors. The photograph is hanging outside of the juror room on the ground floor of the courthouse.

Ethics Seminar: The annual ethics seminar shall take place on November 11, 2008, at the Brookfield Suites hotel. We will apply for 3 ethics credits for this seminar. Christy D'Angelo is finalizing the speakers and Doug Swanson will work with Danni Caldwell to get the sign-up sheets out to the members.

New Business

Revised Bylaws: Discussion was had on revisions to the Bylaws of the Waukesha County Bar Association. Michele Martin will redraft the bylaws incorporating the changes discussed by the Board. The final draft will then be presented to the Board for approval and then presented to the full membership at the annual meeting in May, 2009.

Judicial Achievement Awards: All nominations are due no later than December 18, 2008. We are accepting nominations for Judge of the Year and Lifetime Jurist awards.

Member Notification Policy: The Board discussed how and when the membership will be notified of an event or topic that may be of interest to the membership but not specifically sponsored by the Waukesha County Bar Association. The Board unanimously approved the following policy:
    "If a member would like to notify the general membership of an upcoming event that would be of interest to the membership, the member must contact a Board Director who will bring the issue to the Board for approval at the next scheduled Board meeting. If the Board determines that the event is of interest to the general membership, the membership shall be notified through publication in the Scriptus and/or as an addition to the Waukesha County Bar Association website. If time is of the essence, the membership may be notified via electronic mail at the sole discretion of the Board of Directors."

Judge's Luncheon: The Board voted unanimously to move the date of the Judge's Update Luncheon to the second Monday in January, 2009, as the first Monday (January 5) is also the first working day of the new year. Therefore, the luncheon is now scheduled to take place on January 12, 2009.

Tax Returns: Dan Habeck will follow with Gaylene Stingl to verify that all returns for the Association are completed and filed.

The meeting was adjourned by unanimous consent at 1:00 p.m. The next meeting is scheduled for Thursday, October 23, 2008 at 12:00 p.m., Room G55, Administration Building.*

WCBA Board Minutes - Thursday, October 23, 2008, 12:00 p.m.

Attendance:    Dan Habeck, President, Doug Swanson, President-Elect, Danni Caldwell, Michelle Martin, Craig Kuhary, Judge Linda Van De Water, and Vicki Schroeder.  Members not present: Christine D'Angelo, Jeff Zirgibel, Sam Benedict, Marjorie Wendt, and Sharron Stolpa. 

Minutes:  No Minutes from the September 18, 2008 Board of Directors Meeting were reviewed.  Therefore, we tabled the approval of those Minutes until the November 2008 Meeting. 

Treasurer and Membership Report:  Sharron provided the updated report which shows the membership status as of October 22, 2008 at 427.  The Treasurer's Report shows the 18 month CD having a balance of $13,999.26.  The 24 month CD has a balance of $13,999.51.  The Eagle Money Market has a balance of $6,112.85.  The checking account has a balance of $27,056.16.  A copy of the Treasurer's Report and Membership Report is attached to these Minutes.

Old Business and Committee Reports   

State Board of Governors:  No report was presented.

Scriptus/Website:   The next Scriptus is ready.  We have received proposals from various groups to present small CLE seminars to our membership.  Danni will update the Scriptus and Website to address CLE related issues.  

Ethics Seminar:  Doug reported that the 2008 Ethics Seminar is on track.  To date he has received approximately 70 registration forms.  He has confirmed the date with the Brookfield Suites.  He will meet with the catering department at the Brookfield Suites in advance of the seminar.  He will also try to submit the seminar materials to the Board of Bar Examiners prior to the seminar in an attempt to obtain course approval before the seminar or as soon after the seminar as possible. 

Judge's Luncheon:  The event is scheduled for January 12, 2009 at the Country Springs. 

Member Notification Policy and Practice:  The policy has been posted on the website.

Tax Returns:  Gaylean Stingel does have all the information and the tax returns for the Bar Association will be filed.

New Business

United Way Table:     The United Way has requested a table to present its materials at the Ethics Seminar.  We had done this in the past.  Doug will make those arrangements.  We again addressed our policy regarding requests of groups to make presentations at our seminars.  We had decided not to actively solicit any groups but would make a table in the hallway available for anyone who might want to address our membership.  We will not allow any groups to formally address the membership as a part of the seminar. 

Law Day:   Danni will make a request for ideas or participation in Law Day events in the Scriptus.  We again discussed sending "don't do anything stupid" brochures to high school seniors. 

Local Bar Grant Competition:  The deadline has been extended to June 1, 2009.  A request for ideas will be placed into the Scriptus.

Swift Impact LLC Seminar Offer:   We have been contacted by this organization to present a seminar to our members regarding IT issues, security storage, etc.  We will add this to the list of potential seminars for the spring.

Criminal OAR Policy Information:   Daniel Fay sent a copy of a letter received from Brad Schimel's office to the Criminal Section of the Bar Association regarding the District Attorney's Office policy regarding OAR.  Michelle questioned whether the letter should be provided to all members of the Bar Association, not just those in the Criminal Section.  We decided that Michelle would contact Brad Schimel to advise him that it is our intent to put a copy of the letter in the Scriptus unless he has some compelling reason why we should not do so.

The Meeting was adjourned by unanimous consent at 12:45 p.m.  The next Meeting is scheduled for Thursday, November 20, 2008* at 12:00 p.m., Room G55, Administration Building.

Criminal/Traffic Court

    Attorneys interested in court appointments made as provided under State v. Dean to serve as counsel to defendants determined to be constitutionally indigent but not eligible for representation from the State Public Defender's Office should submit a letter of interest and a resume to the Criminal/Traffic Division Presiding Judge, the Honorable Lee S. Dreyfus, Jr., Circuit Court Branch 5 at the Waukesha County Courthouse, Criminal/Traffic Division, P.O. Box 1627, Waukesha, WI  53187-1627.

    The 2008 hourly rate for representation is established at $40/hr for in and out of court services and $25/hr for travel time if counsel's office is not located in Waukesha County or is in excess of 30 miles one-way from the courthouse.  Charges in excess of these rates must be approved by the responsible judge before the cost is incurred.

CLE Credit Information

      The Fall Ethics Seminar has been approved for 3.5 CLE credits, all EPR credits.  A complete listing of all of the CLE credits available from the WCBA in 2007 and 2008 is on the WCBA website. 
Law Day

Law Day

    The WCBA has not sponsored Law Day in many years. The State Bar and the ABA offer ideas and materials for Law Day activities. Any WCBA members interested in volunteering to coordinate Law Day in Waukesha County, please contact Dan Habeck for information. (262-542-4278 or djh@cmhlaw.com )

Local Bar Grant Competition

    The Wisconsin Bar Association offers grant money to local bar associations for new public service projects that are topical, useful and novel. Information is available on the State Bar website.  The deadline for applying is May 1, 2009. Information can be obtained from Kris Wenzel (800) 444-9404 or dwenzel@wisbar.org.
