A Word From
Your President
Dear Members:
As we move out of winter and into spring, I want to raise two
issues.
The first is that we are accepting nominees for our Spring
Awards. There are certainly many deserving candidates and we look
forward to your nominations.
The second is Law Day. The Bar has not taken an active role with
Law Day in my entire period of involvement. I understand that
historically there have been a variety of events, and that some people
feel strongly about it. We continue to evaluate proposals, both
for this year and the future. Suggestions or recommendations are
certainly appreciated.

Minutes - Thursday,
January 22, 2009, 12:00 p.m.
Attendance:
Daniel Habeck, President; Christy D'Angelo, Secretary/Treasurer; Danni
Caldwell; Michelle Martin and Sharron Stolpa. (No Quorum present.
Meeting was held for informational purposes only. No action was taken
on any items.)
Minutes: The
approval of the minutes from the December 18, 2008, meeting will be
taken up at the next Board meeting.
Treasurer and Membership
Report: The report was received. Approval held until the
next Board meeting.
Old Business and Committee Reports
State Board of Governors
:
No report given.
Scriptus/Website :Next
addition of the Scriptus will be out week of January 26th.
Judge's Luncheon
:55 people were in attendance. A lot of good information was presented.
The food was not as good this year, so we will watch that for next
year.
Tax Return : Per Daniel
Habeck the tax return for 2008 has been filed.
Support Staff Luncheon:
The luncheon will be held on February 3, 2009. Notice and invitations
will be sent by email to all members with email addresses on file
immediately. Members will be asked to RSVP by January 29. Cost is $15
per attorney and one staff member. Entertainment has been arranged from
12:00 to 1:30 p.m.
Spring Awards: The
spring awards banquet will be held on May 2, 2009 at The Legends. We
will begin soliciting award nominees in February. Awards are presented
for Distinguished Member, Lifetime Achievement and Community Service.
Annual Meeting: The
Waukesha County Bar Association Annual Meeting will be held on May 14,
2009, at the Country Springs Hotel. We have invited State Bar President
Diane Diel to be our keynote speaker for that event. Notice will be
given in the Scriptus.
New Business
State Bar Cell Phone Drive: The
State Bar is collecting old cell phones. The deadline for collection of
the cell phones is February 15, 2009. Members will be notified via
email to bring any cell phones to the Support Staff luncheon and we
will collect them at that time.
Catholic Charities CLE: The Archdiocese of Milwaukee has offered to
provide a free CLE on Immigration Law and Immigration Issues.
Discussion was tabled until more Board members were present.
Law Day: Attorney Michelle Fitzgerald has proposed that the
Waukesha County Bar Association get involved in Law Day activities
scheduled to take place around the state on May 1, 2009. Dan Habeck
will communicate to Ms. Fitzgerald that we will support any efforts she
undertakes to coordinate those activities.
Board of Governors: Attorney C. Michael Hausman's term on the
Board of Governors is ending and we will have a vacant seat to fill in
the next State Bar election. The deadline for petitions to fill that
vacancy is March 1, 2009. Interested members can apply online at www.wisbar.org.
The meeting was adjourned by unanimous consent at 12:50 p.m. The next
meeting is scheduled for Thursday, February 19, 2009, at 12:00 p.m.,
Room G55, Administration Building. *

Clerk of Courts
New Director of Family Court Services
Announced
Shari D'Acquisto was selected by the Waukesha County Circuit
Court Judges as the new Director of Family Court Services. She
succeeds Robin Kostroski, who is leaving to spend time with her infant
twins
Shari has been employed in the office performing family court child
custody and placement mediations and studies. One of Shari's first
duties will be to hire a new family court counselor to bring the office
back up to full compliment.

Chief Deputy Clerk of Court Appointed
Clerk of Circuit Court Kathleen Madden has appointed John E.
Cain as Chief Deputy Clerk of Court effective February 23, 2009. John
will oversee the court operations of the Civil and Family
divisions. John has a long history as a litigator working
primarily in the civil area of law and brings strong management and
leadership experience from his work at a fortune 500 company.
Madden is confident John will bring the knowledge, experience,
leadership and enthusiasm essential to successfully direct the
operations of the Civil and Family divisions.
New Local Rule
5.4 SUMMARY JUDGMENT AND DISMISSAL MOTIONS:
(a)
A motion for summary judgment under §802.08, Wis. Stats., or a motion
for dismissal under §802.06, Wis. Stats., shall be filed in the office
of the Clerk of Circuit Court together with any brief, affidavit(s), or
other supporting documents. If movant does not desire to file a
brief, affidavit(s), or other supporting documents, movant shall file a
statement waiving the right to file such brief, affidavit(s), or other
supporting documents. Prior to service and filing, movant shall
obtain from the clerk a hearing date, and movant shall send notice of
the hearing date to all attorneys of record and/or parties not
appearing by an attorney of record.
(b)
Responding party shall serve and file a brief, affidavit(s), or other
supporting documents, or a waiver in writing on the right to do
so. If responding party fails to file any brief, affidavit(s), or
other supporting documents, or a waiver thereof, within the time limit
set for response, it shall be presumed that the responding party has
waived the right to do so.
(c)
Movant shall serve and file a brief limited to matters in reply.
Failure to timely file a reply brief shall be a waiver of the right to
do so.
(d)
A court order may prescribe a procedure different from this rule. Refer
to Scheduling Order for deadlines related to the hearing of said
motions and filing of supporting and opposing documents.

Member News
Free CLE Opportunities - May 14, 2009
As noted on the calendar at the top of this newsletter, WCBA
will again offer CLE after the Annual Meeting on May 14. The Board of
Directors and Officers decided at the February Board meeting to
reach out to our sections and ask them to sponsor breakout sessions of
interest to their members and WCBA general members. The Real Estate
section was the first to respond. Their monthly meeting will be held
after the WCBA Annual Meeting and will feature speaker Dayten P. Hanson
of Hanson & Payne LLC. He will speak on tax and bankruptcy
issues. All WCBA members are invited to attend.
As other sections respond, we will be informing members about those
sessions. In addition, we are contacting speakers who indicated
an interest in presenting CLE to our members. If you know of a
speaker willing to make a presentation or a topic that you would like
to learn more about, please contact Dan Habeck (262-542-4278 or
djh@cmhlaw.com) with your ideas!
Nominations Sought
At our annual Spring Awards Dinner, we honor three worthy
individuals. We are seeking nominations for the following awards:
Lifetime Achievement: 10
consecutive years or more of WCBA membership who has achieved
excellence in the field of law over a substantial time period, has
consistently conducted himself or herself with dignity, has portrayed
the WCBA and the Waukesha legal community in a positive light, and has
or had a license in good standing. The nominee need not be retired.
Community Service Award: Need
not be an attorney, but must have provided volunteer, community, or
public service to any part of Waukesha County over many years,
consistently conducted him or herself with dignity, helped Waukesha
County people, and portrayed the Waukesha community in a positive light.
Distinguished Member Award:
A member of WCBA for at least the past 5 years and who has a license in
good standing (not disbarred), who has served the WCBA with distinction
by devoting time and effort to improve and promote this organization,
has promoted high standards of fairness, justice, and ethical conduct
within the legal profession and has portrayed WCBA and the Waukesha
legal community in a positive light.
The membership form is attached to this issue, and is also available to
download and print from the WCBA website. All nominations are due
on March 20 and should be faxed to Dan Habeck (fax: 262-542-4270).
Law Day Update
The January minutes, above, indicate that we had a volunteer to
conduct Law Day activities. Unfortunately, we learned at our
February meeting that was no longer the case.
If you have any interest in conducting Law Day activities, no matter
how big or small, WCBA is prepared to offer support. Please
contact Dan Habeck (262-542-4278 or djh@cmhlaw.com) to discuss your
ideas or willingness to volunteer.
